Terms of supply
Interpretation: In these Conditions:

 

“Arrival” means the date on which the Services are to be provided or shall start to be provided by The Burlington Hotel;
“Client”
means the person for whom The Burlington Hotel has agreed to provide the Services in accordance with these Terms;
“Contract”
means the contract for the provision of the Services including these Terms as appropriate;
“Services”
means the provision of accommodation; function room hire and/or supply of food and beverages and other Services by The Burlington Hotel for the Client described in writing by The Burlington Hotel and on its website or in its brochure.
“Schedule”
The Schedule of deposits and payments and cancellation terms annexed to this Agreement;
“Standard charges”
means the charges shown in any brochure of the The Burlington Hotel or other published literature relating to the Services in force from time to time;
“Terms”
means these terms and conditions.
“Group”
a group booking comprises of six rooms or more and may also include other contracted services and use of The Burlington Hotel’s facilities
“Event”
means an event that takes place in one of the Hotel’s private dining rooms or suites

Reservation Terms and Conditions

Your reservation and the accommodation agreement made with The Burlington Hotel (whether made by you directly with The Burlington Hotel or via a third party such as a travel agent) will be subject to these Terms.

When you make your reservation, whether online or by telephone, you will be deemed to have read, understood and accepted these Terms.

If you make your reservation via a travel agent, or other third party, then you have a separate legal relationship with that party and The Burlington Hotel has no liability for any acts or omissions of such party including their observance of your data protection rights.

 

Online Reservations

The Burlington Hotel website and telephone facility enables you to check the accommodation offerings and availability of the hotel (and related products and services), as indicated to The Burlington Hotel, and then submit an online or telephone reservation request. On completion of the reservation process, the Reservations Facility will transmit an online or email confirmation of your reservation. A reservation is only valid when a reservation number has been issued. Relevant details relating to products and services must be confirmed by you directly with The Burlington Hotel.

Hotel Prices
The Burlington Hotel’s information may contain technical inaccuracies and typographical errors, including but not limited to inaccuracies relating to pricing or availability applicable to your transaction. The Burlington Hotel does not assume responsibility or liability for any such inaccuracies, errors, or omissions, and shall have no obligation to honour reservations or information affected by such inaccuracies. The Burlington Hotel reserves the right to make changes, corrections, cancellations, and/or improvements to The Burlington Hotel information, and to the products and programmes described in such information, at any time without notice, including after confirmation of a transaction.

Payments
It will be necessary for you to provide credit card details to secure a room, product or service reservation. The credit card may then be used by The Burlington Hotel for payment of a deposit as advised at the time of booking or as a guarantee for a future payment, in the case of a no-show, a cancellation or change to the reservation.

The Client shall pay the estimated final balance of any reservation at least 2 weeks prior to the event. Any further charges due to additional guests or other persons attending any function, or caused by changes to the Client’s requirements, shall be paid at least 7 days prior to the event in the absence of any other written agreement. The Burlington Hotel reserves the right to charge interest on any outstanding invoices at a rate of 2.5% per month. 

Cancellations and amendments
You should make any cancellations or amendments to your reservation using the same Burlington Hotel channel through which you booked, either online or by telephone. The cancellations and amendments policy that applies to your reservation will depend on the respective policy as advised at the time of booking.

Check in times
Check in time for accommodation is from 3pm. An early check in can be pre-booked and requested but is not guaranteed.

Check out time is by 11am. Late check outs until 11.30am can be requested – subject to availability. For late check outs after 11.30am, a fee of £20 per hour will apply and is subject to availability.

Early Departure
The Burlington Hotel has an early departure penalty fee, and some room, product and service rates may also require a minimum stay. You may change your check out date without a penalty only if your rate and The Burlington Hotel’s policy permits.

Supply of services
The Burlington Hotel shall provide the Services to the Client subject to the Contract.

The Client shall at its own expense supply The Burlington Hotel with all necessary data or other information relating to the Services within sufficient time to enable the The Burlington Hotel to provide the Services in accordance with the Contract.

The Client shall ensure the accuracy of all such information. Specific information requirements are contained in the Schedule. The Burlington Hotel may at any time without notifying the Client make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services.

The Burlington Hotel does not condone any form of bullying or harassment in the workplace. If the harasser is a guest or a visitor to the hotel, the employee should instead convey promptly and clearly their feelings of discomfort to a manager and explain if it is interfering with their work. The manager will then deal with the matter in the most appropriate manner. The employee is strongly discouraged from raising this personally with the guest.

Rate Requirements
As some rates have special requirements at check-in, you should verify that you qualify for the rate that you have reserved. The Burlington Hotel are not obligated to honour this rate if you do not qualify or do not have proof of qualification.

Pre-paid Reservations
Some rate plans require prepayment in full and are non-cancellable, non-refundable, non-changeable and non-transferable. This will be identified in the rate description. For these rate plans, once you make a reservation your credit card will be charged for the full amount. Credit will not be given for any unused reservation and the amount paid by you for such reservation cannot be used toward any other/future reservation.

Overbooking
In the event that a guest cannot be accommodated due to The Burlington Hotel overbooking or an unforeseen circumstance, we will attempt to accommodate guests, at its expense, at a comparable property in the area for the night(s) for which The Burlington Hotel is unable to accommodate such guests and will pay for transportation to that property.

Special Requests
The Burlington Hotel will strive to honour any request for specific room types or bed types, and we will confirm such arrangements at the time you make your reservation. Until specific confirmation is issued then your request cannot be guaranteed, and The Burlington Hotel cannot guarantee that your request will be honoured.

Guest’s obligations
You agree to the terms and conditions of purchase imposed by The Burlington Hotel. You also agree that you are fully responsible and shall pay for all charges, fees, duties, taxes, assessments, and other amounts arising out of your reservation when due, including additional taxes and fees that may not be included in the quoted rate.

You understand that any violation of The Burlington Hotel conditions may result in cancellation of your reservation and you forfeiting any monies paid for such reservation and The Burlington Hotel debiting your account for any costs it incurs as a result of such violation.

Loss or damage to properties, fixtures or fittings
The Client shall at all times be liable for the cost of any damage to the Company premises, and for any damage to or loss of the Company’s property.

Where such loss or damage results in loss of business revenue to the Company, the Client shall additionally be liable for damages in respect of that. In respect of this, and generally, the Client agrees to be responsible for any such loss or damage caused by any guest of the Client. For the purposes of this part of the contract, loss or damage shall be deemed to include any cleaning costs incurred by the Company as a result of any unreasonable behaviour or activity of the Client or any guest of the Client. As regards the loss of, or damage to, the Company’s property, the Company reserves the right to charge the Client the cost of replacing or rectifying any loss or damage by making a charge to the Client’s credit or debit card.

The Client agrees that the Company may do this without making further reference to nor seeking further authorisation from the Client. The Company shall not be held responsible for any damage to, or loss of any property or equipment left on the Premises prior to, or following, any event or function. Any lost property recovered will be held for 14 days. Any such property which is not claimed within this time will be disposed of at the discretion of the Company.

The Burlington Hotel is a strictly a non-smoking hotel. Smoking is not permitted anywhere inside the hotel. Any room contaminated with smoke will be charged a £130.00 deep clean fee. Our smoking policy applies to all guests visiting or staying at The Burlington Hotel and applies to all rooms.

Force Majeure
The Burlington Hotel will be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond the control of The Burlington Hotel. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, earthquake, volcanic activity, ash clouds, tsunamis, fire and explosions.

Advertising
In respect of any events which involve external promotions, the Client shall not make any reference whatsoever, in any advertisement on public display, to any of the Company’s associated names. These include, but are not limited to, ‘The Burlington Hotel’ and ‘The Burlington’.

This term may only be varied by written permission from the Company. The Company will not accept responsibility for any advertisement, poster or other material which contravenes any law governing the control of advertisements or litter. In the event of the Company or any of its servants, agents or employees being ordered to pay any financial penalty by the courts or any public authority or being presented with any claim for damages by any person as a result of the Client’s failure to comply with this term, the Client shall be responsible for all such costs or damages incurred by the Company or any of its servants, agents or employees.

Group reservations
A reservation of six rooms or more is considered a group booking. If you wish to make a group booking, please call the hotel directly.

The maximum room occupancy is two adults. Some of our rooms can accommodate two adults and up to two children (under the age of 13) and one infant (in a cot). You must not exceed the maximum occupancy for the room allocated to you. We reserve the right to conduct checks on occupancy. Occupancy is not transferable.
Children aged 13 years and over are classified as adults.

Please note that if you do opt to book an additional bedroom or an interconnecting room for your children, this will be charged at the full adult rate.
Under 18’s are not permitted to stay in our hotel unless a parent or guardian is also staying in the hotel. We reserve the right to request valid photographic proof of identity and age, so please bring this with you otherwise where requested you will not be permitted to stay.

Function room hire Terms and Conditions

Deposits
Upon provisionally reserving function facilities or use of any of the facilities of The Burlington Hotel, the Client will provide written confirmation, a signed copy of these terms and conditions, and a non-refundable booking fee in order to secure the booking. The written confirmation shall contain details of the expected number of guests. Please note that all deposits are non- refundable, except at the discretion of The Burlington Hotel. We reserve the right to vary the prices of the goods & services quoted at a time of booking, according to economic climate conditions, or other factors that may be a cause of such variations. Some, functions will also require a refundable security deposit to be held during the duration of the event. If this is required, you will be informed upon booking the event. So long as The Burlington Hotel deems that no additional costs have been incurred to the venue during the function, this deposit will be returned, in full, as early as the end time of the function. Full details of the procedure carried out in the event of any loss or damage deemed to be the responsibility of The Client or any guest of The Client are noted in section 5.

Settlements
The Client shall pay the estimated final balance of any reservation at least 2 weeks prior to the event. Any further charges due to additional guests or other persons attending any function, or caused by changes to the Client’s requirements, shall be paid at least 7 days prior to the event in the absence of any other written agreement. The Company reserves the right to charge interest on any outstanding invoices at a rate of 2.5% per month.

Cancellation
In the event of cancellation for whatever reason, every effort will be made by The Burlington Hotel to resell the facilities booked by the Client (including accommodation if more than 3 rooms are booked). However, all deposits are non-refundable, except at the discretion of The Burlington Hotel. In circumstances where the Client has cancelled the booking, or where The Burlington Hotel is required to cancel the booking for any of the reasons listed below, and where The Burlington Hotel is unable to resell the facilities (including accommodation), then the Client will forfeit the full cost of the booking or reservation.

In circumstances where The Burlington Hotel has been able to resell the facilities in question, the Client shall be refunded 50% of the final balance of the reservation, not including the deposit. The Client will give notice of cancellation in writing. Depending on the length of period given cancelling the event, may result in full costs applying. The Burlington Hotel reserves the right to cancel any function or other reservation for any of the following reasons:

• Closure of the premises or any part of them, due to fire or other unforeseen infrastructure events or by order of any public authority
• The Client becoming insolvent or entering into liquidation/receivership
• If within 1 day or more of the event, and if in the Directors/General Managers reasonable opinion, the function or event may compromise the reputation of The Burlington Hotel, the Premises or the safety of its employees, hotel residents or any other person
• If, in the opinion of The Burlington Hotel, or on the advice of any local authority, either the Client or any of his/her servants, invitees, guests or representatives act in a manner considered to be prejudicial to the good name of The Burlington Hotel or its Premises
• In the event of any of the above, The Burlington Hotel shall be at liberty to terminate the contract or event at any time and shall not be liable to make any refund or compensation to the Client.

Final details for function room hire
The Client shall provide final guest numbers, menu choices, beverage (including alcohol) selections and quantities to The Burlington Hotel at least 10 days prior to the event in question. Any additional guests not included in the original numbers after the final payment was made will be paid for by the Client immediately. The Company will not be liable to make any refund to the Client in the event of any guests not attending on the day of the function. The Company reserves the right to vary the menu or wine specified in the event of unavailability of such items. The Client will inform the Company in writing, addressed to the relevant Premises, at least 10 days prior to the event, of any guests attending any function who may have food allergies or special dietary requirements, etc. The Company shall not be liable to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from the late or non-arrival of information by the Client.

Loss or damage
The Client shall at all times be liable for the cost of any damage to the Company premises, and for any damage to or loss of the Company’s property. Where such loss or damage results in loss of business revenue to the Company, the Client shall additionally be liable for damages in respect of that. In respect of this, and generally, the Client agrees to be responsible for any such loss or damage caused by any guest of the Client. For the purposes of this part of the contract, loss or damage shall be deemed to include any cleaning costs incurred by the Company as a result of any unreasonable behaviour or activity of the Client or any guest of the Client. As regards the loss of, or damage to, the Company’s property, the Company reserves the right to charge the Client the cost of replacing or rectifying any loss or damage by making a charge to the Client’s credit or debit card. The Client agrees that the Company may do this without making further reference to nor seeking further authorisation from the Client. The Company shall not be held responsible for any damage to or loss of any property or equipment left on the Premises prior to, or following, any event or function. Any lost property recovered will be held for 14 days. Any such property which is not claimed within this time will be disposed of at the discretion of the Company. Please be advised it is forbidden to smoke in our rooms. Any room contaminated with smoke will be charged £130.00 deep clean fee. Our smoking policy applies to all guests visiting or staying at The Burlington Hotel and applies to all rooms.

Music and entertainments
The Client shall inform the Company of any proposed third-party contracts for entertainment or services for any function and reserves the right to prohibit the same. The Company at all times reserves the right to determine the level of noise in order to prevent nuisance, and the Clients shall adjust it accordingly. Any function requiring a DJ must use the Company’s ‘in-house’ DJ so as to comply with Licensing and Health and Safety Regulations. Any third-party entertainment must hand a copy of a valid public liability insurance certificate to the Management of the hotel at least 14 days prior to the event. The Company shall not be responsible for any entertainment provided by the Client in contravention of this term, nor in failing to observe all relevant regulations and copyright laws. In the event of the Company being ordered to pay any financial penalty by the courts or any public authority or being presented with any claim for damages by any person as a result of the Client’s failure to comply with this term, the Client shall be responsible to the Company for all such costs or damages.

Disturbance
The premises are a late-night entertainment venue. Whilst the Company shall endeavour to ensure that guests are accommodated appropriately, it will not be liable for any noise or disturbance caused by guests, their functions or entertainment being held on the premises, including the arrival or departure of guests or Clients from the premises.

Security
All functions taking place require security due to strict licensing regulations. This door security will be provided by the Company. For any other functions or events at the premises, the company reserves the right to appoint door security whenever the Company deems this to be appropriate. All guests will be subject to the usual admission and ejection regulations of the Coral Lounge function room. Entrance to the Coral Lounge is strictly for persons aged over 21 only, unless when the venue is being used for the sole purpose of a private function when the youngest age of any guest admitted will be 14 years of age. In respect of this, the company operates a zero-tolerance policy on anyone found to be consuming alcohol on the premises without valid I.D. There is no age restriction for functions taking place in the Princess Amelia and Pearl rooms or the Coral Lounge however, the usual admission and ejection regulations will be in operation in regards to alcohol sales. Where additional security is required, the Company reserves the right, at its discretion, to charge this to the Client. Where possible the Company will advise the Client of this in advance. In any event, the Client shall be liable to reimburse the Company for such cost, regardless of whether the Company has provided such advance notice.

Credit
Credit facilities must be applied for in writing to the Company prior to the date of the function. Credit may be authorised by the written permission of a Director or General Manager of the Company only. In all cases, and for all events, functions or other use of the facilities, the Client’s credit card details will be required. In addition, the Company may obtain from the client a pre – authorisation of payment from the credit card before the commencement of the function, event or other use of facilities. Immediate payment of any outstanding balance will be required. In the event of there remaining any outstanding balance of payment due from the Client to the Company, the Company reserves the right to obtain such outstanding payment directly from the credit card as pre–authorized by the Client. Further to this, the Client agrees that the Company may take such payment from the client’s credit card without further reference to, or authority from, the Client.

Maximum numbers of persons
The maximum capacity for each area of the Premises is as follows: Coral Lounge: 200 persons standing, or 50 sitting (depending on layout) The Princess Amelia Room: 150 persons standing, or 60 sitting. The Pearl Room: 35/40 persons standing or 20/25 sitting. The above numbers are the maximum permitted under the terms of the relevant fire and licensing regulations, and under no circumstances may they be exceeded.

Room bookings
Clients reserving 3 or more bedrooms in conjunction with functions and group bookings must submit a detailed list of names and numbers of guests per room at least 14 days prior to the booking. A minimum of 72 hours’ notice of cancellation is required. In the event of non-arrival, a charge will be made for 1 nights’ accommodation per room. Unless otherwise notified, the remainder of the reservation will be cancelled, and appropriate cancellation charges will be applied as set out in paragraph 3. above. Clients responsible for block room bookings must ensure that each guest receives a copy of the Company’s ‘Guest Information sheet’. This is available from The Burlington Hotel reception upon request. The primary Client who initially booked the rooms or any of the facilities remains responsible for all guests, including those aged 17 years or under, unless the Company is informed in writing in advance of the name(s) of the relevant guardian or parents. All persons aged 17 years and under must be always accompanied by an adult aged 18 or over and are not permitted in Gio’s bar after 9pm on Sunday through to Thursday evenings, or after 8pm on Friday and Saturday.

Other
Goods, services, food or beverages may not be bought, sold or consumed on the Premises unless supplied by the Company.

Outside events
Where any independently employed or hired persons (e.g. DJs, event coordinators, entertainers, bands, speakers etc.) or other staff or workers not employed by the Company, are authorised to be on the Premises, such persons are not permitted in any area ‘back of house’ and are not authorised to touch or otherwise interfere with any Company equipment without express prior permission.6Any other written information made available to the Client by the Company shall be deemed to be incorporated herein and in the event of any dispute, the terms and conditions contained in this document will prevail. No modifications to these terms and conditions shall be binding upon the Company unless the same be in writing and duly signed by a properly authorised director or manager of the Company.

Refund policy
All deposits are non-refundable. Any further refunds are down to the discretion of management.
